Upcoming False Claims Act Mock Trial Institute

The 2024 False Claims Act Mock Trial Institute hosted by the American Bar Association (ABA) will take place in Washington, D.C. from Jan. 17-19 and will be available for Continuing Legal Education (CLE) credit. I am looking forward to this three-day mock trial event discussing the False Claims Act (FCA) and will be speaking on a panel entitled, “Can I Do That? Ethical Concerns for Private, Relators, and Government Counsel,” on the first day of the event. 

In my panel, I will address ethical issues from the defense counsel’s perspective in a False Claims Act case, including discussion of ethical issues related to internal investigation and evidence collection, responding to CIDs, confidentiality and privilege, communicating with organization representatives, government counsel, and many more issues that arise when handling these cases. Additionally, FCA bar counsel will speak about their experience with similar issues and how they deal with them in the most effective way. Other presenters include Habib Ilahi, a partner with Schertler Onorato Mead and Sears LLP; Ashley Bailey, a senior trial counsel with the US Department of Justice; and Jackie DeMar, the director of legal education with The Anti-Fraud Coalition.
