Josh advises providers of wireline, wireless, Voice over Internet Protocol, and satellite services on domestic and international compliance and licensing, as well as Universal Service Fund (USF) requirements. He also counsels technology companies and unlicensed and licensed users of spectrum on compliance strategies. Josh advocates on behalf of clients at the Federal Communications Commission (FCC), before state commissions, and on Capitol Hill. He provides comprehensive telecommunications due diligence reviews and advises on technical and regulatory compliance, including new voice and data services for compliance with FCC and state regulations.

Josh also counsels on the USF’s Lifeline program, including on FCC and state requirements, gaining approval for FCC compliance plans, obtaining eligible telecommunications carrier designations from states and the FCC, stock and asset transactions, operating and management agreements, transfers of control and audits, and enforcement matters. Experience

  • Represented clients in all aspects of the USF Low-Income Program and Affordable Connectivity Program, including legislative and rulemaking advocacy, preparing and advancing compliance plans, developing regulatory compliance strategies, preparing and prosecuting applications for eligible telecommunications carrier (ETC) status at the FCC and state commissions, advocacy before state commissions, and successful litigation against both the FCC and state public utility commissions
  • Drafted advocacy comments to the FCC in many proceedings, including rulemakings dealing with universal service, intercarrier compensation, access to public rights-of-way, spectrum allocation and reallocation, broadband deployment, net neutrality/open Internet, E911, local franchising, and flight test spectrum
  • Advised equipment manufacturers, telecommunications carriers, VoIP providers, and providers of advanced communications services like electronic messaging and interoperable video conferencing, including major video game developers regarding compliance with accessibility requirements for people with disabilities, the FCC’s recordkeeping requirements and annual certification and registration obligation
  • Provided regulatory advice and strategic counsel regarding stock acquisitions and asset purchase agreements for carriers and technology companies
  • Assisted a fixed wireless and fiber optic network-based Internet Service Provider and VoIP provider to obtain multiple ETC licenses from states, as well as additional supporting licenses, within 180 days in order to receive over $200 million in FCC funding to deploy broadband and voice services in rural unserved and underserved areas pursuant to the FCC’s Connect America Fund (CAF) Phase II program, and again to obtain additional licenses and amend existing licenses following participation in the Rural Digital Opportunity Fund (RDOF) auction
  • Assisted a manufacturer of field disturbance sensor radars to obtain a waiver of the FCC’s rules to increase power levels and advocating for changes to the rules in the 60 GHz proceeding
  • Prepared responses and strategies for Universal Service Administrative Company audits for Lifeline-eligible telecommunications carriers and Affordable Connectivity Program participating providers
  • Assisted carriers to negotiate and draft consent decrees with the FCC’s Enforcement Bureau
  • Assisted Mobile Virtual Network Operators with FCC and state regulatory licensing, compliance, and strategies necessary to enter the U.S. market
  • Assisted clients with applications for the transfer of control of wireless licenses and Section 214 authorizations, as well as successfully clearing the applications through national security review by the Executive Branch when necessary
  • Assisted aeronautical, maritime, and land mobile satellite service providers with experimental and commercial licensing at the FCC
  • Advised an owner of fiber networks on regulatory and contractual due diligence in the acquisition of an E-rate service provider
  • Advised client with the preparation and filing of a Petition for Rulemaking with the FCC to allocate spectrum and develop technical, operational, and licensing rules for stratospheric-based communications services
  • Prepared a monthly summary and analysis of spectrum policy for a defense and aerospace government contractor
  • Advised a major equipment manufacturer on compliance with closed captioning requirements
  • Drafted a brief in support of and motion to intervene in an appeal of a state public utility commission rule change regarding the implementation of the Universal Service Low-Income Program
  • Advised one of Japan’s largest telecommunications carriers on the FCC licensing implications of acquiring a major Pacific submarine cable operator, conducting a comprehensive due diligence analysis of the acquired cable landing licensee, and advising regarding Section 214 licensing for various service offerings
  • Provided a major Asian telecommunications carrier with a comprehensive FCC regulatory due diligence analysis for the acquisition of a U.S. carrier
  • Assisted one of the world’s largest carriers with a 50-state licensing strategy and preparing and prosecuting license applications
  • Drafted a comprehensive telecommunications and cable code for a U.S. state government
  • Assisted an FCC licensee with spectrum lease and sublease applications
